Penalties for a DUI Violation in Illinois

In the state of Illinois, a first conviction of driving under the influence is considered a Class A misdemeanor, which is just below a felony in severity. In general, DUI cases are prosecuted more harshly in Illinois compared to other states. Class A misdemeanors carry the potential for up to a year in prison and up to $2,500 in fines.

For a third DUI offense, the charge becomes a Class 4 felony known as aggravated DUI, with a sentence of between one to three years in prison and as much as $25,000 in fines. Other aggravating circumstances in DUI cases include driving at twice the legal limit for blood alcohol content (.16%), drunk driving with a minor under the age of 16 in the car, or committing DUI with a suspended license.

Even a first DUI conviction can result in the loss of your license. If you failed a chemical blood alcohol test after being arrested, you will lose your driving privileges for six months, and if you refused testing, the length of the suspension is doubled to 12 months.
